By accessing or using the SearchBrand platform (the "Platform"), operated by Growth SpA, Tax ID 77.824.037-8, with address at La Capitanía 80, office 108, Las Condes, Santiago, Chile (hereinafter, "SearchBrand", "we", "us"), you fully accept these Terms and Conditions (the "Terms") and our Privacy Policy.
If you do not agree with these Terms, you must refrain from using the Platform.
We may modify these Terms at any time. Modifications will take effect upon publication on the Platform. Continued use of the Platform constitutes acceptance of the current Terms.
User: natural or legal person who accesses or uses the Platform.
Services: analysis, monitoring, AEO, SEO, search engine and AI assistant visibility functionalities, and associated tools.
Content: information, data, reports, metrics, analyses or results generated by the Platform.
Credits: virtual consumption units used to execute certain functionalities or actions within the Platform, whose equivalence, value and form of consumption may vary according to the Service or contracted plan.
Credits do not constitute money or credit balance.
You represent that you have the legal capacity to contract and that you meet the age of majority required by applicable law.
To access certain Services you must create an account. You agree to provide truthful and up-to-date information and to maintain the confidentiality of your credentials.
You are responsible for all activity conducted from your account. You must immediately notify us of any unauthorized use.

SearchBrand may modify, update, suspend or discontinue Services in whole or in part, including beta functionalities, at any time.

Material changes will be communicated with reasonable advance notice as indicated in clause 7.
The Platform operates wholly or partially through a credit system.
Each functionality or action requiring credit consumption will clearly indicate in advance:
Credits:
The User is responsible for reviewing credit consumption before confirming any action.
SearchBrand may modify the way credits are allocated, consumed or required for certain functionalities.
Any material change affecting credit consumption or the economic logic of the Service will be previously communicated through one or more of the following means:
Voluntary execution of the action after such notification constitutes express acceptance of the change.
The User may choose not to use modified functionalities without penalty.
The Platform, its software, design, trademarks and content are the exclusive property of Growth SpA or its licensors.
The User is granted a limited, non-exclusive, non-transferable and revocable license to use the Platform in accordance with these Terms. No rights other than those expressly indicated are transferred.
Personal data processing is governed by our Privacy Policy, in accordance with Chilean Law No. 19.628 and, where applicable, the GDPR.
We may use depersonalized and aggregated data for statistical, analytical, Service improvement and benchmarking purposes, without identifying the User.
The Platform may integrate with third-party services (for example, analytics providers, payments or external APIs).
Where applicable, the use of such services will be governed by their own terms and policies. SearchBrand does not control and is not responsible for such external services.
Current prices and plans are published on the website and may be modified with prior notice.

Payment Processor
Payments are processed by a third-party payment provider acting as the Merchant of Record for all our orders. This provider handles payment processing, invoicing, customer service inquiries, and returns.

The User may cancel their subscription at any time from their account or through support.
SearchBrand may suspend or terminate access for breach of these Terms, abusive use or security risks.
Upon termination of service:
The Platform is provided "as is" and "as available". We do not guarantee uninterrupted operation or absence of errors, although we will make reasonable efforts to maintain its continuity.
To the maximum extent permitted by law, SearchBrand disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
SearchBrand's total liability is limited to the amount actually paid by the User during the 12 months prior to the event giving rise to the claim.
We will not be liable for indirect, incidental, consequential damages or loss of data, revenue or opportunities.
The User agrees to indemnify and hold SearchBrand harmless against third-party claims arising from use of the Platform in violation of these Terms or the law.
Notifications will be sent to the email address associated with the account and/or through notices within the Platform. They will be deemed received within 24 hours of sending or publication.
The User may not assign these Terms without prior consent. SearchBrand may assign them in case of reorganization, merger or asset sale.
These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of justice of Santiago, Chile.
